How does the mediation process begin?

The process begins with an initial individual consultation lasting 60 to 90 minutes. During this meeting, Sandy Kovacs, an experienced lawyer and mediator, will explain the process, set expectations and answer any questions you may have.

What kind of issues can be addressed during mediation?

Mediation can address various issues, including property division, child custody and support arrangements. Sandy helps set an agenda based on the identified issues to ensure all critical matters are discussed.

How are the mediation sessions conducted?

Mediation sessions can be conducted in person or virtually, depending on your preference. The number and length of sessions depend on the complexity of the issues. Some cases may be resolved in one full day, while others may require several shorter sessions.

Can the mediator provide legal advice during the mediation?

As a mediator, Sandy cannot provide legal advice to either party. He can inform you of relevant laws and ensure that the agreements comply with legal standards, but specific legal advice must come from your own legal counsel.

What happens if we choose not to seek independent legal advice before signing the agreements?

While Sandy strongly recommends that you obtain independent legal advice before finalizing and signing any agreements, the choice ultimately lies with you. If you decide not to seek this advice, you can still sign the agreements prepared during mediation.  

Does this recommendation apply if we are represented by counsel during mediation?

No, if you are represented by counsel during the mediation, the recommendation to seek independent legal advice before signing does not apply, as your lawyer will provide the necessary legal guidance.

Can the mediator inform us about the law during mediation?

As your mediator, Sandy can inform you about the relevant laws and legal considerations that may impact your agreements. However, this should not be considered legal advice, which must come from your individual lawyers.
